Performance Guarantee. It's one thing for Local Yokel to claim it's 20/20 Store Program is a good choice for your business. But it can be a bit daunting to plunk down your hard-earned money and commit to a 12-month subscription. There's a slew of "what if" questions that can make you hesitate. "What if Local Yokel doesn't get enough traffic and qualified buyers to the website for my store to be a success?" "What if I don't make enough to break even on the cost of the subscription?"

Local Yokel wants you to succeed. We know that won't happen unless you jump in and go for it. That's why we're backing our 20/20 Store Program with a Performance Guarantee. We guarantee we'll do our part and attract enough buyers to get the job done. Performance Guarantee Is a Limited-Time Offer

The Performance Guarantee is included in the 20/20 Store Program as an introductory offer. Local Yokel plans to continue the 20/20 Store Program indefinitely. However, the Performance Guarantee will be dropped from the 20/20 Store Program after a reasonable introductory period has transpired, and it will then no longer be possible to initiate a subscription that includes the Guarantee. Of course, the Guarantee will continue in force throughout the 12-month term of any 20/20 Store subscription that included it when it was purchased.

Here's the official statement of the Performance Guarantee for the 20/20 Guaranteed Store Program.

20/20 Store Program Limited Performance Guarantee

LocalYokelAuctions.com (LYA) conditionally guarantees to provide sufficient Buyers to LYA such that a registered Member (Store Owner), who purchases a subscription to the 20/20 Guaranteed Store Program (GSP), shall receive, on average, during the term of the subscription, gross receipts from sales and/or from commissions equal to or exceeding the subscription cost or else LYA will refund the difference to the Store Owner.

Subscription Cost: the total fee paid by the Store Owner for a GSP subscription, including any amount credited from an upgrade.

Gross Receipts: the cumulative total of the following amounts during the term of the subscription.

  1. Sales. Any item, for which the Store Owner is the Seller, is considered sold when the listing closes during the subscription term and at least one Buyer is identified. The selling price of sold items is included in gross receipts, whether the item was listed in the main site, in the store only , or in both, even if the listing's Start Time predates activation of the GSP subscription. Other charges to a Buyer, such as shipping, handling, and insurance, are excluded. Selling price is included in gross receipts whether or not the Store Owner/Seller actually collects payment for the sale. LYA and any agents acting on behalf of LYA are prohibited from buying items without providing payment.
  2. Downline commissions. Gross receipts include all commissions posted to the Store Owner's account in accordance with the LYA Referral Program. (See http://localyokelauctions.com/ref_prog.php)
  3. Upline commission from the GSP subscription. The Store Owner's purchase of a GSP subscription immediately posts commissions to all qualified accounts upline from the Store Owner's account, in accordance with the LYA Referral Program. Any such commissions posted to upline accounts owned or controlled by the Store Owner or by any member of the Store Owner's household are included in gross receipts for the purpose of this Guarantee. Upline accounts are viewable from the Members Area of LYA. Upline accounts owned or controlled by the Store Owner or by any member of the Store Owner's household are considered commonly held upline accounts. The Store Owner must disclose to LYA any and all commonly held upline accounts. A STORE OWNER'S FAILURE TO DISCLOSE COMMONLY HELD UPLINE ACCOUNT(S) VOIDS THIS GUARANTEE. Any refund paid under the terms of this Guarantee is subject to reversal if LYA discovers that any commonly held upline accounts were not disclosed by the Store Owner.
  4. GSP Refunds. Amounts refunded for any monthly period during the term of the GSP subscription are included in gross receipts for all subsequent monthly refund determinations.

GSP Subscription Term and Payment. The GSP subscription consists of twelve (12) successive monthly store subscriptions, payable in full at the time of activation. The subscription fee is non-refundable, except under the terms of this Guarantee. A prorated credit for the unused portion of the current subscription may apply when upgrading to a higher level GSP subscription.

Automatic Renewal A twelve-month subscription initiated by automatic renewal qualifies the new subscription for the Performance Guarantee only if LYA is offering the Performance Guarantee to all members purchasing the same subscription level at the time the automatic renwal occurs.

Refund Determination. LYA does not automatically monitor individual Store performance. If a refund is due for any given monthly period, the Store Owner must submit a Refund Determination Request within twenty one (21) days after the close of the monthly period in question. Refund Determination Requests may be submitted by telephone, email, or through the form on the Contact Us page at LYA. (See http://localyokelauctions.com/content_pages.php?page=contact_us) Upon receiving a Refund Determination Request, LYA will compute gross receipts through the close of the period in question and the sum of average monthly costs through the close of the same period. If total gross receipts is less than monthly costs through the period for which the determination is being made, LYA will refund the difference or the average monthly cost for the period, whichever is smaller.

Store Owner Requirements. In order to keep this Guarantee in force throughout the duration of the GSP subscription, the Store Owner must

  1. pay the annual subscription fee in full.
  2. keep the Store active for at least one (1) year.
  3. stock and maintain Store inventory with items or services, the value of which meets or exceeds the average monthly cost of the GSP subscription.
  4. customize and maintain Store Logo, Store Categories, and all available Store Pages.
